Land Use Mediation

The Pennsylvania Municipalities Planning Code, the state-wide enabling legislation for zoning, subdivision, and land development contains a mediation option relating to matters before a zoning hearing board or municipal governing body. This option provides a viable alternative to extensive and expensive litigation involving real estate, land use, and zoning. Mediation is an optional, voluntary method for resolution of hotly contested land use applications and controversies, a professionally guided dispute resolution between/among parties who agree to talk and negotiate. Through mediation, disputes may be reduced or resolved in a manner which is less formal and more conciliatory. The benefits of mediation can include speed in achieving resolution, control of the process and mediator, an opportunity to narrow the issues, and the ability of the disputing parties to maintain a working relationship.
