Sean M. Corr Secures $320,000 Arbitration Award for Injured Man
Eastburn and Gray litigation attorney Sean M. Corr recently secured a $320,000 award following arbitration proceedings in Philadelphia. Mr. Corr represented a man who suffered a significant leg injury after a head-on collision with a vehicle which crossed into the center lane of traffic. Mr. Corr’s client was unable to work for a year, and endured significant pain and suffering as a result of the accident.
The other driver’s insurance company refused to make any reasonable settlement offer, forcing the parties to seek judicial intervention. However, in a strategic move which saved thousands in costs and eliminated any delay involving appeals, Mr. Corr orchestrated an agreement to remove the case from the Philadelphia court system and send the matter to binding private arbitration, where it was resolved just a few weeks later.
In the process of securing the award, Mr. Corr was able to defeat the insurance company’s argument that any payment made on account of lost earnings would be reduced by the amount of income taxes the plaintiff would have paid had he been working. While the insurance company acknowledged that taxes were not owed, they claimed that they, not the injured man, should receive the benefit of the award’s tax-free status. This victory resulted in the plaintiff keeping approximately one-third more of the award. Corr cites this as an example of why it is important to be represented by an experienced lawyer in such cases.
