Biography

David Marshall has extensive experience in bankruptcy, commercial litigation and insurance coverage. He initially represented businesses and homeowners who had suffered casualty losses. That work has expanded to include claims for disability insurance coverage and coverage under the National Flood Insurance Policies. David also handles personal and corporate bankruptcies and loan workouts. His practice includes representation of debtors and creditors in bankruptcy court litigation involving preferences and adversary actions. His experience includes:

  • Representation of minority shareholders in closely-held corporations.
  • Successfully collected on an award in excess of $1 million for oppressed minority shareholders.
  • Litigated commercial disputes, including shareholder and business divorces, entity liquidations and restrictive covenants.
  • Obtained the transfer of all partnership assets based upon the partners’ capital accounts on behalf of clients that had previously been excluded from partnership management and had been denied access to partnership financial records.
  • Negotiated a workout on behalf of a corporate client of a money judgment in excess of $500,000.
  • Confirmed plans in individual and corporate Chapter 11 bankruptcies.
  • Successfully litigated motions to dismiss adversary complaints under Bankruptcy Rule 7012.
  • Litigated objections to proofs of claim.
  • Restored 8(a) status for an approved minority enterprise under the SBA Business Development Program.
  • Worked with SBA lenders on cash collateral motions.
  • Represented creditors with regard to confirming proposed plans.
  • Frequently works with forensic accountants and other financial experts to value assets, claims and capital accounts.

David is a member of the Bucks County Bar Association, the American Bar Association, and the Eastern District of Pennsylvania Bankruptcy Conference.

David is admitted to practice before the United States Tax Court, the United States Court of Appeals for the Third Circuit, the United States District Court for the Eastern and Middle Districts of Pennsylvania, the United States Bankruptcy Courts for the Eastern and Middle Districts of Pennsylvania and the Pennsylvania bar.

Education

David graduated from the Woodrow Wilson School of Public International Affairs at Princeton University. He received his law degree from the University of Georgia School of Law, where he was Notes Editor of the Georgia Journal of International Law. He received his L.L.M. in Taxation from Temple University.
