Biography
Ralph Kelly has more than twenty-five years experience handling a wide range of complex litigation matters from contractual disputes and business torts to professional malpractice matters and real estate related litigation and construction claims. He also has extensive experience in employment law where he regularly counsels employers and employees and litigates cases involving discrimination, disability, ERISA, noncompete, trade secret and other areas. Admitted to practice in Pennsylvania and New Jersey, Mr. Kelly's active trial practice includes both federal and state courts and various administrative and arbitration tribunals.
Representative experience includes:
- Obtained summary judgment in the defense of the sellers of a niche engineering firm on a $10 million claim for breach of representations and warranties and related fraud claims.
- Successfully defended former officers of a publicly traded pharmaceutical company charged with breach of fiduciary duty, effectively cross-examined expert forensic accountant and two business valuation experts.
- Won accountant’s malpractice jury trial verdict against regional accounting firm that failed to detect defalcation by client’s bookkeeper.
- Represented Commonwealth Authority in a bid protest, defeating motion for injunctive relief, and ultimate dismissal of the claim for the Authority.
- Successfully defended Trustees of multimillion dollar real estate trust in a breach of fiduciary duty claim by co-trustee in an Orphans’ Court proceeding.
- Jury verdict for manufacturing facility for breach of contract for the installation of a faulty roof against a national roofing supply company.
- Jury verdict for ice cream manufacturer against a national supermarket for breach of contract.
- Defended Philadelphia- based casino in multiple mechanics’ lien claims brought by general contractor and subcontractors in multi-million-dollar expansion project.
- Successfully defended home health care company in claims involving FMLA and ADA leave issues.
Prior to joining Eastburn and Gray, Mr. Kelly was a trial attorney at the McShea Law Firm, litigation partner with Dilworth Paxson and shareholder and chair of the commercial litigation department of Abrahams Loewenstein.
Education
Mr. Kelly received his J.D. from the University of Pennsylvania Law School and his B.A., magna cum laude, from Saint Joseph’s University.
