Public Works Employment Verification Act 127 of 2012

Beginning January 1, 2013, the Public Works Employment Verification Act will require all contractors and subcontractors engaged in public work construction projects to utilize the Federal Government’s E-Verify system to confirm that all employees performing work comply with U.S. employment eligibility requirements. “Public work” is defined as all construction, reconstruction, demolition, alteration and/or repair work other than maintenance work where the estimated total project cost exceeds $25,000.00. This also applies to contracts awarded prior to January 1, but executed after that date.

The new requirements affect both onsite and offsite workers. Penalties for noncompliance include disbarment and fines.
