Marc D. Jonas, Esq. Secures Court Approval of Settlement Permitting New Restaurant at Switchville Commons in Abington
Marc D. Jonas, Esq. successfully represented Duke Real Estate Partners, LLC in the Court of Common Pleas of Montgomery County. The court approved a settlement of an appeal by objectors which sought to overturn an approval of a new restaurant at the Switchville Commons property in Abington. The court-approved settlement permits the 4,000 square foot restaurant to be constructed on the terms as approved by the Abington Township Board of Commissioners. Bernie’s restaurant is a family-style restaurant which will add excitement to the Switchville Commons property already occupied by LA Fitness.
Mr. Jonas had successfully represented the developer in 2008 when a new overlay zoning district was enacted to permit the development of the Switchville Commons property. In addition to LA Fitness and the new Bernie’s restaurant, the developer has the approval to construct a multi-story office building on the site.
